Terms of Service
Last updated October 23, 2026
These Terms are an agreement between you and Elsebox (“Elsebox”, “we”, “us”) about your use of elsebox.dev, the Elsebox dashboard, the Elsebox Mac app, the Elsebox MCP servers (the npm package elsebox-mcp and the connector at elsebox.dev/api/mcp), the cloud Windows machines we run for you, and everything we provide through them (the “Service”). By creating an account or using the Service you agree to these Terms. If you use the Service for a company, you agree for that company and confirm that you are allowed to.
The short version
- Your files and your code stay yours. We don’t look at what is on your machines.
- You are responsible for what you and your AI agents do on your machines.
- No mining, attacks, spam, malware or anything illegal. We stop machines that do it.
- Plans renew automatically until you cancel. Hours you don’t use don’t carry over.
- Machines are not backed up. Reset and delete remove their files for good.
1. Who we are
The Service is provided by Elsebox. You can reach us at help@elsebox.dev.
2. What the Service does
Elsebox gives you Windows machines in the cloud. You, or an AI agent you connect (such as Claude Code, Codex or another MCP client), can create, start, stop, reset and delete machines, see their screens, use the mouse and keyboard, run commands, and copy files to and from them. You can watch and use a machine live in your browser or in the Mac app. Machines run in the data center region you choose. We improve the Service over time, so features may change.
3. Your account
- You must be at least 18 years old, or the age of majority where you live if that is higher.
- You sign in with Google or with codes sent to your email. Keep your inbox and your Google account secure, because anyone who can use them can sign in as you.
- API keys and connected apps act as you. Keep keys secret, and revoke a key or disconnect an app under API keys as soon as you no longer trust it.
- You are responsible for everything done under your account, including by AI agents and apps you connect.
- If you think someone else has access to your account, tell us right away at help@elsebox.dev.
4. Your machines and your content
“Your content” means the files, code, programs, settings and anything else you or your agents put on a machine or send through the Service.
- You keep all rights to your content.
- You give us a worldwide, non-exclusive, royalty-free license to store, copy, transmit and process your content only as needed to provide the Service to you. It ends when you delete the content, the machine or your account.
- We don’t look at the files on your machines or watch your sessions. Our systems read only what they need to run a machine, such as whether it is up, its address and the fingerprint of its security certificate. We look further only when you ask us to, or when we have good reason to believe a machine breaks section 7.
- Machines are not backed up. Keep copies of anything you need. Resetting a machine puts a clean disk in it, and deleting a machine deletes its disk. Neither can be undone.
- You confirm that you have the rights needed for your content and that using it with the Service does not break any law or anyone else’s rights.
5. Windows and other software
- Machines run Microsoft Windows Server and developer tools we install, licensed to us by Amazon Web Services and their makers. You may use them only on your machines, as part of the Service. Microsoft’s and the other makers’ terms for end users apply, and you may not remove or get around their license protections.
- Software you install yourself is between you and its maker. You are responsible for having the licenses it needs.
6. AI agents
- When you connect an AI agent, it acts for you. What it sees on your machines, such as screenshots and command output, goes to the agent and to the AI company behind it under your agreement with them.
- AI agents make mistakes. Review what they do, and don’t give them access you would not give a person helping you.
7. Acceptable use
You may not use the Service, or let anyone use it, to:
- mine cryptocurrency, or run other work whose main purpose is to burn computing power;
- attack, scan, probe or overload other systems or networks, or get into accounts, systems or data you are not allowed to;
- send spam or bulk messages, or run bots that break the terms of the services they use, such as fake accounts, fake reviews or automated purchases;
- create, store or spread malware, phishing pages or other harmful software;
- store or share content that is illegal, sexualizes minors, infringes others’ rights, or promotes violence or terrorism;
- resell or share machines as a hosting, proxy or VPN service, or get around the limits of your plan, for example with several free trials;
- break any law that applies to you or to us, including sanctions and export rules.
If a machine is used this way, or is causing harm to others, we may stop it or block its network at once, and tell you why. For serious or repeated breaches we may close your account (section 10).
8. Plans, hours, payment and renewal
- Paid plans are sold through Polar (Polar Software, Inc.), which acts as our reseller and merchant of record. Polar processes your payment, charges sales tax or VAT where it applies, and issues your receipts. Your purchase is also subject to Polar’s terms for buyers.
- Prices are in US dollars and shown before you pay. Taxes are added at checkout where they apply.
- Each plan includes a number of Standard hours per billing period. A machine uses them while it runs; a Light machine counts half, a Power machine double. Hours you don’t use don’t carry over.
- When the hours run out, running machines stop and can’t start again until the next period, unless you allowed overage. Overage is charged per minute at the price shown on your plan.
- Subscriptions renew automatically at the end of each billing period, monthly or yearly, at the price then in effect, until you cancel. You can cancel at any time in Usage & billing. You keep your plan until the end of the period you paid for, and you are not charged again.
- We will tell you at least 30 days before a price change applies to your next renewal. If you do not agree, cancel before that renewal.
- If you think you were charged by mistake, write to help@elsebox.dev within 30 days and we will look at it. Where the law gives you a right to a refund, you keep it.
- If a payment fails, we may stop your machines until it is paid. Your machines and their files stay.
9. Availability and changes to the Service
- We work to keep the Service running, but we cannot promise it will be uninterrupted or without errors. Machines can stop because of failures at our providers.
- If we remove a feature that is an important part of a plan you pay for, we will tell you in advance, and you can cancel and get a refund for the unused part of your billing period.
10. Ending your account
- You can stop at any time. Delete machines in the dashboard, and write to help@elsebox.dev to delete your account. We then delete your data as described in the Privacy Policy.
- We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect the Service or other people. We will tell you why and, where it is reasonable, give you a chance to fix the problem and to copy your files first. If we close your account without such a reason, we refund any prepaid amount for the unused period.
11. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract.
12. Limitation of liability
- To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, lost profits or revenue, or lost data, including files on machines that were reset, deleted or lost.
- Our total liability for all claims about the Service is limited to the amount you paid us in the 12 months before the claim, or 100 US dollars if you paid nothing.
- These limits do not apply where the law does not allow them, for example to liability for intent or gross negligence, or for death or personal injury caused by negligence.
13. Indemnity for business customers
If you use the Service for a business, you will defend us against, and compensate us for, claims by third parties caused by your content, by what you or your agents do on your machines, or by your breach of these Terms. This section does not apply to consumers.
14. Sanctions and export
You may not use the Service if you are located in, or ordinarily resident in, a country or region under comprehensive sanctions of the United Nations, the European Union, the United Kingdom or the United States, or if you are on a sanctions list. Paid plans are only available where our payment partners operate.
15. Changes to these Terms
We may update these Terms. For changes that matter, we will email you at least 14 days before they take effect. If you keep using the Service after that, the new Terms apply. If you do not agree, you can stop using the Service and cancel your plan.
16. Disputes
- If something goes wrong, please write to us first at help@elsebox.dev. Most problems are solved that way, and we try to solve every one within 30 days.
- If you are a consumer living in the European Union, the United Kingdom or another country whose law gives you protections that cannot be waived, you keep those protections, and you may also bring a claim in the courts where you live.
17. General
- These Terms, together with the Privacy Policy, are the whole agreement between you and us about the Service.
- We may transfer this agreement to a company that takes over the Service. You may transfer it only with our written consent.
- If a part of these Terms cannot be enforced, the rest stays in force. Not enforcing a right is not a waiver of it.
- We are not responsible for delays or failures caused by events outside our reasonable control.
- These Terms are written in English. If a translation ever differs from them, the English version applies, unless the law where you live requires otherwise.
- We send notices by email or in the Service. You can send notices to us at help@elsebox.dev.
